So easy to bash up and coming riders -- please note that even the best riders of the day were up and coming at the outset of their careers. buckpasser · As a lawyer, I just want to make a point about the differences in systems between England and USA regarding violations. First of all, the BHA has complete control. It is an administrative body who allows a hearing and one appeal and then the punishment is set and is then sent to all other jockey clubs in the world who are signatories of the agreement among AND have renewed the agreement properly. This last part is very important as England recently dealt with a case of a British jockey that the India jockey club wanted banned for six months but the ban was not enforced worldwide because India had not renewed the agreement so the jockey could ride anywhere but India. As I have written before our Jockey USED to have this level of enforcement powers but the owners and breeders broke it up. Now you have state which are administrative bodies which allow internal appeals and there is always an appeal to a court of law and the attendant appeals through the legal system. This is one of the reasons that violations pile up before action is taken, because a severe penalty could reversed on an appeal is there is only one infraction under the heading of arbitrary and capricious and bias. It is not letting things slide because of a big name. It is because of the legal system present. Finally one last point: the trainer in England in effect plead guilty and accepted the punishment. Hence no appeal even in the BHA's limited process. The trainers involved in American process all have plead not guilty and hence ONeill, Pena, Dutrow etc. continue to take appeals. Also as to big names in England, the BHA did not further investigate whether the owner was involved in the drugging. They asked the trainer, he said no and that was the end of the matter. For any ones information, the BHA could have launched more of an investigation but they didn't. They and the Sheikh wanted this to go away. They had someone to punishment end of discussion. When you post on this issue, please try and understand the differences in the legal systems and the facts of the matter. footlick · Actually, buck passer, I do understand the issue. There are more ongoing investigations in England going on. The case was easier with the Sheikh's trainer because he brought the drugs into England and hand delivered the syringes to an assistant and told them to inject the horse int he muscle. Other trainers who have admitted using an anabolic steroid had a vet administer it and the steroid was injected into the joint, not the muscle. The performance enhancing effects happen when it is injected into the muscle, not the joint, as far as I understand. From what I have read, they are allowed for use in Dubai and Australia as long as the drug is not in the bloodstream by race day. The problem is the performance enhancing effects last much longer than the drug in the body. This has made people question the performances of the Aussie sprinters in England, whether they had an unfair advantage. The Sheikh's other barn in England is not necessarily being ignored. The trainer in question did what he did and had to know what he was doing. Whether the Sheikh knew about it or didn't know about it was not part of the legal case. Just like the swift action in the Dettori case, Europe does things differently and swiftly. That we allow trainers to continue to drag things out is obvioulsy the way we do it. IMO, it is not better and does nothing to clean up the sport. · 16 days ago ·

You don't get an appeal if you plead guilty. The other matter that is interesting is that the legal doctrine of respondeat superior has not been applied meaning simply if you employ someone, his actions are imputed to you as his employer on a theory of strict liability. This common law doctrine has not been applied here at all in the Sheikh's case which is interesting in and of itself. Also they would not be taking appeals if a ban etc was not handed down, so they are punishing people, it is that the offenders, some of them, have deeper pockets or their owners do to finance them. One final point, we don't let just trainers drag out their appeals, any administrative decision is appealable to a state ct and can be overturned only on the standard of bias, capriciousness or arbitrariness. In Europe they seem to distinguish between the perpetrator and other parties. They may have already looked into the Sheikh's involvement or as you say are just favoring him over other people. If we do not let trainers drag out their appeals then I guess we have the slowest system in the world, as far as legal or illegal activity is concerned. And if everyone is ok with that, then who am I to say otherwise. I guess I just don't understand why we have rules if they can be gotten around so easily and sentences can be postponed indefinitely. buckpasser · On the European continent, civil law as opposed to common law is the rule of law. Totally different legal system with totally different rules. England and the US, except Louisiana, have common law where the doctrine of respondeat superior would govern. This doctrine is factual determination whose main element is exclusivity, ie the person only works for you or such a large amount that he is not considered an independent contractor. A jockey in this situation would be a independent contractor. A trainer, maybe maybe not a factual determination. buckpasser · Thanks footy. That info would makes sense. England like other Commonwealth countries does not have the nolo contendere plea, or Alford plea as it is called. Where in effect you plead no contest, but are afforded certain rights depending on the jurisdiction. So England then clearly allows an appeal of the sentence itself in this circumstance. His appeal probably looks similar to our arbitrary and capricious standard but they call it something different. Since they are looking at other aspects of the Sheikhs organization but are keeping mum over their findings, they are clearly concerned about the extent of the violations and want to make sure it was an isolated incident or incidents. Clearly this investigation would factor into the severity of a penalty for the trainer etc. I do admire their thoroughness in this matter and clearly no one in British racing is ignoring the issue. · 15 days ago ·

Shouldn't the real question they should be asking be how high in the Godolphin management food chain did knowledge of the corruption exist. Gopolphin continued employing Al Zarooni a trainer who had drug (pain killer) positives at Newmarket in 2012 and got the proverbial slap onthe wrist. So for upper management to claim shock that their livestock were being drugged seems disingenuous at best. I give him (Al Zarooni) credit for falling on his sword like a good boy spilling his guts to investigators to the point of even pointing out the untested horses he had doped. If a barn containing among the absolute best pedigrees money can buy feel compelled to gain an advantage, how likely is it that smaller, less well funded barns are not following the same training regimen. I would assume that this case with the level of horses and people involved, means they will be looking at other lesser stables as well. The appeal that the trainer here is taking, which no one disputes, could well open up a Pandora's box if there are even more violations. The BHA new has to make sure their original sentence sticks. To do that, they may need more evidence and if so, they will look at all matters, including any of the evidence that they felt they had for the charges they didn't go with. Personally, if I were the lawyer for the Dheikh or his trainer, I would shut this down. Take the sentence and shut up because any additional evidence could make things worse. · 15 days ago ·

buckpasser · As a small aside, years ago when I was in horse showing in the hunter and jumper classes, there was the killing of horses for insurance money that ended up nailing Olympic riders like Barney Ward, top people like George Lindemann, Buddy and Donna Brown etc. etc. the Feds actually stumbled upon the case by accident assuming the conversations they had involved a contract on a person and not a horse. They started this case and it was like peeling an onion, more and more issues and wrongdoing turned up including buying slaughter bound horses and putting in barn, burning it down and collecting insurance money based on the supposed deaths of top show horses who were actually alive had their names changed and sold abroad. It also led to solving the Helen Brach murder etc. I was asked by someone high up in this matter for my legal opinion on what he should do as the Feds were after him in the first queries. I told him cop a plea and wear a wire to nail the higher ups that the Feds really wanted. I warned him if he didnt take my advice, someone else would wear the wire and cop the plea. He dismissed me and ignored my advice. Needless to say, what I told would happen did. Why I told him to do that was to also direct the Feds interest and keep focused on one particular group of people. Once you let an investigation continue, it finds many other issues hiding under various rocks. It took several years to get everyone in this mess, but it put a lot of people in jail and forced a lot out of the horse show world and some big names. My point in this long discourse, is that if there is an issue and a continued investigation, you have no idea where it leads and to whom. · 15 days ago ·

buckpasser · Footy. I do agree that the drug issues and medication violations are widespread in America. I don't know where you got the idea that I disputed it. I didn't. All I tried to do is to explain our legal system. Whether you agree or not, administrative hearings here are faster and render a quicker decision than if you started the procedure in a court. A decision is an administrative hearing is usually rendered in less than 30 days and this includes the trial aspect, evidentiary discovery etc. In a court situation, 30 days is the start of the case with the serving of summons and complaint. You don't even get an actual date for months even years for a trial. What you are complaining about is the appeal process and than can be longer. What you may not realize is that penalty may well apply during the appeal process unless a stay has been granted. You may think England's system is wonderful. It may be more streamlined, but it has the same issues when instituting a stringent penalty. Frankly, this case with the Sheikh's trainer could be a real tiger by the tail. And as I said before investigations can have a life if their own and lead in directions than no one realizes and turn up violations that were not seen coming before. That was why I pointed out the horse show scandal that I had a peripheral involvement in. That started with a belief that a mob hit was about to take place, instead a horse was lead up a van ramp and its leg was broken with a crowbar. It started in Florida and by the time it was finished it involved cases in every state except Alaska and Hawaii. It solved cold case murders of Helen Brach and several grooms etc that disappeared on Jahns property in Illinois. All investigations have unti tended consequences, this one in England could well too. · 15 days ago ·

What did you think about him polling his Facebook followers if he should appeal the severity of the ban? I am assuming appealing the length of the ban doesn't change the fact that he is still banned. Is the appeal going before a court or is it in front of another board? You are very caught up in legal o process, so I was interested in what you hd to say about certain things I thought you would find interesting in this case. But, I guess not. buckpasser · As to al Zarooni going in front of the board without a lawyer, question is he allowed to bring one into the proceedings. Some proceedings do not allow a lawyer in. I thought I read in one of the cases on the BHa site, that lawyers were not allowed in the actual hearing. As to polling his face book followers, this is the new media where people put god knows what on Facebook and twitter, iam not surprised at the ridiculousness of many people regarding social media. Whether he is banned or not pending the appeal depends on the authority or enabling statute granting the procedures and requirements under which this board is founded. In America it is called an Enabling statute. I have no idea what authority defines this board in England. I would assume a parliamentary act as the basis. In that act or enabling statute would define all their procedures, requirements etc.. As I read, not in your article, but on the BHA site, they have an appeal within the organization that involves additional hearing officers. As I have read they have not scheduled a new hearing as their investigations are continuing. As to how long Dutrow was allowed to train pending an appeal, it would revolve around whether he received a stay of the penalty by either the administrative body or a court of law. If no stay, penalty continues and he can't train. If he has exhausted his appeals without an overturning of the original decision, he is serving his penalty. As to the British system, if the administrative appeal is the last word and there nothing else to which this decision can be appealed, that's it. The decision is then disseminated to the other jockey clubs and the ban is in place to the jockey clubs that have signed the treaty and renewed it properly. · 15 days ago ·

I have made no bones that I do not know much about the British boards composition or work other than the transcripts of the few cases I read that they published on their site. Just so you know, in America in most administrative bodies, a decision is not published as it has no precedent value even if the facts are similar. Since England publishes their decision including reasoning behind leads me to believe it may have precedent value in other cases. But I don't know if this is true. Many of the questions you have posed involve answers that can only come from the authority that constituted this board. The article doesn't answer my questions. buckpasser · Footy I reread the piece in the April 30 issue of RP on Butler and some of the questions asked of the BHA in that matter. Then I reread the piece on al Zarooni, I am beginning to think that the hearing in England is very different from what we have here. In the US, our hearing is a mini trial with everything but the jury. It is condensed into a day or more but it involves a full legal presentation. In England, it almost looks like a recitation of charges with the real hearing involved in the appeal because he has hired a barrister to represent him. Also the evidence is continuing to be gathered for this appeal, which makes wonder about it. Also the Butler case, in the little bit I read looks like it was very sloppily handled. I do agree about why wasn't the case moved on to a conclusion a lot faster. · 15 days ago ·

footlick · Against my better judgement, I am back just to point out some glaring differences between the two cases. Butler documented the injections of a steroid that was approved for use in Britain through a vet. He ordered the steroid through a vet and a vet administered it into the joint, not into the muscle. He sent everything to the BHA. Since he didn't hear anything about it, he assumed everything was fine since he went through the proper procedures. The point is that he sent proper documentation to the BHA making them aware of the situation. Al Zarooni, on the other hand, brought the steroid into the country himself, handed syringes to his assistant and instructed his assistant to inject the horses in question in the muscle not the joint. He did not provide any documentation nor did he send any documentation to the BHA. He also did not order the steriod from a vet and have a vet administer it. Everything, on the surface, was done to deceive. There is such a huge difference, also, in where the steroid is injected as far as what effects it has on performance enhancement. Supposedly, and we would need a vet to substantiate this, injecting an anbolic steroid into a joint does not have the performance enhancing effect that injecting it into the muscle does. One trainer was honest and above board in the use, hiding nothing and documenting everything. The other was dishonest, documenting nothing so there would be no paper trail at all. Whether the BHA was sloppy in the Butler case, or felt that the use of the steroid was appropriate and did not pose a threat to performance enhancement, consequently not taking any action, is something you have already commented on, so your opinion is on record. Whether you feel that what shadowno said is more valid than innuendo is also on record. Butler wanted to make sure he brought up his case, knowing eventually it would come to light again. He was being honest and straight forward, wanting to make sure no innuendo could be said about his barn. I wish all trainers were like that. · 15 days ago ·

Also there was a discussion about the particular drug company and whether the label etc was entirely accurate. But I will tell you this as I read it, I thought something is not right. Certainly the questions asked of the BHA wondered the same thing. As to innuendo, this is the last I will say of it, for years the joke in showing circles was how many horses did George Lindemann kill and bury back of his farm. The answer was 8 and that was after the Feds brought in the back hoe and dug the farm out. Gossip may not be entirely accurate, but the old saying where there is smoke, there is fire. He also goes on to say that AZ offered only ignorance as his only defense to the original charges. Lee goes on to say that AZ could be hit with a longer sentence if any more tests are positive and could lose his license for ten years or more. Lee states that AZ's defense may include expanding the blame for the incidents. I guess I am not the only one who sees the potentially explosive aspect of this matter. CauseForConcern · I find Kevin Krigger to be very poised. Still, to say that he handled a crowd of 33,000 @ Santa Anita pales in comparison with circa 150,000 at Churchill. I have heard it said by other jockeys that rode in the Derby, that when they turn for home, they run into a "wall" of cheering, that is very frightening, when first you encounter it. Stewart Elliott also won at first asking, and Jeremy Rose did well in the other Triple Crown events. One thing, for sure, is that there will always be "new" faces. Good luck, Kevin.
